EDIT: After speaking with many sources, the following I no longer find to be true. This law is Constitutional in all aspects and is not a racial law. It is only considered racial because of those who say it is. We are all immigrants. We could care less if you are white, black, purple, pink, orange, or red. This law targets those that are ILLEGAL.
In the following, the parts about the Federal Government ignoring Arizona’s cry for help as well as the responsibility of the states to step up when the Federal Government doesn’t do its job, I still find true.
I’ve stuck mostly to the ideals of America but with Arizona’s new law, I felt that a look on how it’s a good thing, but also needs a little editing, would be good. It is estimated that after the bill was signed into law, that 100,000 illegals fled the state. I agree that it’s up to Arizona to govern its own state, but they have to stick within the Constitution of the United States.
The argument comes from Section 1 of the 14th Amendment.
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
The argument behind this is what documentation will the person in question be asked to present to verify their citizenship? I mean, I don’t think any of us carry our birth certificates around.
I agree that the Federal Government has put a deaf ear to Arizona’s pleas for help, which Arizona has the right to under the Constitution. I believe that if the Federal Government doesn’t do it’s job, then it’s up to the States to do it. But, I believe that the law is written just a tad poorly and they have to be just about it and follow the Constitution.
I believe a simple bit of reworking to this law would easily fix this and make it a very constitutional law. The current law was written in desperation and desperation can cause a few errors.
What the 14th Amendment says to this is basically that we can not punish our own citizens to go after the illegals or even our own citizens. I agree that a bill like this is needed in many states, but we have to adhere to the constitution and make sure that we follow it and live up to the same standards that we want the legislators, executives, and judical officers to live up to.
